GENERAL TERMS & CONDITIONS
Scope of Work
The Photographer provides the photography Services (refer to the invoice for details regarding services, inclusions, booking date and fees) whereas the Client in return provides compensation for such services and expertise. The general description of all Services and fees can be found on the Photographer's webpage: https://www.greenmuse.photography/packages The description of the Wedding Packages is provided in the Price Guide.
Booking fee and payment
2.1 The reservation of the Photoshoot date is only effective upon the payment of booking deposit by the Client, which amounts €150 for sessions (for weddings: 50% of the total service fee) + any additional travel costs, if applicable. The booking deposit is not refundable and guarantees the reservation of the Photoshoot date. The remaining balance must be paid within 7 days after the Photoshoot date. No photos shall be released until a substitute full payment is made and clear funds have been received.

2.2 The Client shall pay any extra expenses related to the organisation of the Photoshoot, such as: unforeseen travel costs, property rental fees, charges, fees, expenses and disbursements required by photo studios. If the shooting time exceeds the agreed time according to the booked service package, the Client may be charged €300/hour based on the actual time spent.
2.3 Photoshoot locations outside Antwerp are subject to the travel charge of €0,65/km.
Delivery of product
Photos will be delivered as high-resolution professionally edited JPEG files in an online client gallery. RAW files will not be provided. When the online gallery is delivered, it shall remain open for 30 days from delivery date.

- Session packages: include a curated gallery of high-resolution professionally edited digital images (min 70 images for the 2 hour package and min 100 for the 3-hour package). The photographs will be delivered within 6 to 8 weeks from the photoshoot date via online Client Gallery. ​

- Wedding packages: The full gallery of high-resolution professionally edited digital images will be delivered within 3 to 5 months from the photoshoot date via online Client Gallery. The Client will also receive 50 fully edited ready-to-use sneak peeks (for the packages starting from 6 hours) within 7 workdays from the shooting date but not earlier than the balance is paid. The gallery remains open for 60 days from the delivery date.
Copyright law
The copyright of the Photographer remains with the Photographer. The Photographer grants the Client permission to make copies of the images under the following conditions. The downloaded images are for personal use of the Client and their family and friends. Sale, Commercial publication or any other Commercial use of the photographs is not allowed without prior written permissions from the Photographer.
Rescheduling
5.1 Sessions: In the event that the Client requests to reschedule its session on account of illness, emergency, act of God or any cause outside its control, the paid booking deposit will be applied to a rescheduled session provided that notice is given at least 7 days prior to the scheduled Photoshoot (or reasonable notice in the case of an emergency). Requests to reschedule by Client for any reason other than a reason under clause 5.1 is at the discretion of Photographer.

The rescheduled session must take place within 3 months of the original session date (longer period only upon agreement between Photographer and Client) and is subject to the availability of Photographer.
5.2 Weddings: In the event of the Client cancelling the Wedding for whatever reason the booking fee is non-refundable. It will be considered as liquidated damages to the Photographer. In the event that the Client requests to reschedule the Wedding, the paid booking deposit will be applied to a rescheduled session provided that notice is given at least 10 months prior to the scheduled date.

The new date must be confirmed within 6 months after requesting the reschedule. If the new date is not confirmed within that period, the original deposit is forfeited. Otherwise, it will be applied to a rescheduled session. Any rescheduled wedding date beyond the original year is subject to annually updated package pricing.
Cancellation
6.1 In the event of the Client cancelling the Photoshoot (or Wedding) for whatever reason the booking fee is non-refundable. It will be considered as liquidated damages to the Photoshoot.
Artistic Vision
7.1 The Client accepts that the shooting materials are an intangible product, which is created based on an artistic vision of the Photographer, and agrees to this vision. Photographer retains the right of discretion in selecting the photographic materials released to the client. The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer. The artistic style of the Photographeris publicly showcased on their website portfolio and on Instagram page for Client's information prior to booking.
Model Release
8.1 The Client grants the Photographer and its legal representatives the irrevocable and unlimited consent to use the photographs of the Client for portfolio, editorials, competitions, advertising and any other purpose and in any manner, to alter the photographs without restrictions, and to copyright the images. The Client hereby releases the Photographer and its legal representatives from all liability and claims in connection with the images. The Client may request the privacy of some images but the decision in this regard is entirely left to the discretion of the Photographer.
Limit of Liability
9.1 If the Photographer is unable to perform the Services due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God or any cause outside its control, Photographer will reach out to the Client as soon as possible to reschedule. The Client will be entitled to choose: to reschedule or to require a full refund.
In case of Wedding: the Photographer will try to book a replacement photographer. If the replacement photographer cannot be found then liability is limited to a refund of any payments received. If the fees to be charged by the replacement photographer exceed the fees payable by Client for the agreed Services, the Client will be entitled to choose: to engage the replacement photographer (in which case, the Client shall be liable for any additional fees charged by the replacement photographer); or to require a full refund.
9.2 The Photographer has working methods in place to prevent loss or damage to the images. However, If the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged within or beyond the Photographer control, the Photographer will not be liable for any consequential loss arising from the non-delivery, and the liability of the Photographer to the Client should be limited to the return of fees paid for the services or part thereof according to the percentage of images supplied.
